Claim Culture And The People Behind It

Are we being suffocated by Claim culture? some would say yes. Others would say it is a necessary way to keep people safe. We live no doubt in the most litigious society in history. People will sue at the drop of a hat as the saying goes. But we have to realize also that there are many legitimate cases of negligence that leaves people injured for life.

There is not doubt about this. And the law cannot find a better way with trying to make injured people whole than by awarding them money for their pain and suffering and for their injuries. One famous commercial for a personal injury law firm has one of their clients saying the firm got him over a million dollars in settlement.

But who would want to get a money settlement of that size if it meant having to live in a wheelchair for the rest of life? The money can never make an injured person whole if the injury is one that is life long and debilitating. The law has never come up with a better remedy than money though.

But there are those who file false claims and try to hit the lottery. Many slip and fall cases are like this. People will slip and fall and then sue the insurance company for a large settlement. And in step the lawyers.

The lawyer will assume the person has suffered a severe injury and send his client over to the doctor who will report soft tissue injury and pain and injury. You see there are so many lawyers out there and there are only so many personal injury cases to go around. The lawyers have to make the most of what comes into their office.

This is what is meant by the claim culture we live in today. Many get injured and think that their ship has come in. But the lawyers are there to help them with there arrival. They will send them to doctors who will agree to all sorts of pains and injuries the client will claim.

Why anyone in this day and age go into personal injury law cannot be answered. There are not even enough clients out there to feed the lawyers out there already let alone bringing on more lawyers to the scene. The more lawyers the more you have them trying to make a case so they can pay their legal secretaries this year.

And this is not to say that people are not to blame either. One lady demanded that a pedestrian provide his name and address to her. He had crossed in front of her in the crosswalk. The driver behind her almost her her and had to brake suddenly. She thought in case that driver would sue her in case he hurt his neck by stopping quickly she needed to be able to sue the man who crossed in the crosswalk legally for causing her to stop. And thus our culture of claim and blame moves on.
